In an effort to make water flow easily through pipeline, the board of trustees of the Northeast Texas Municipal Water District authorized change order #2 for the ground storage tank in Daingerfield.

General Manager Walt Sears said the change order is to increase the communication of the delivery points along the Daingerfield-Lone Star pipeline.

“This modification will make it easier to deliver water to all three destinations,” he said. “It continues to be anticipated that the project will remain ahead of schedule and within budget expectations.”

In other business, Michael Atchley of the law firm of Pope, Hardwicke, Christie, Schell, Kelly and Ray fromFort Worth was hired by the board to represent thedistrict in the bankruptcy that has been filed by Luminant and related companies. The parent company is called Energy Future Holdings Corp. “The reason why the district needs a lawyer is that it has a contract for future delivery of water that is in excess of $10 million,” Mr. Sears said. “The bankruptcy court has the ability to review contracts and adjust terms of contracts when appropriate. The move to hire a lawyer is designed to protect the district’s existing contract and the revenue that is created by that contract.

“This firm is representing other water districts from the perspective of protecting the existing contracts.” The board was informed that Lake O’ the Pines is full.

“Lake O’ the Pines is approximately 5 inches above full at this time,” Mr. Sears said. “Lake Bob Sandlin is about 9 inches low, but is storing the most water as it has stored since early summer of 2010. Lake Bob Sandlin is as full as it has been in four years.”
